Uttering a death threat is illegal in Canada under section 264.1 of the Criminal Code.

Yes, but shouting "kill Modi" into the air is not a threat, and certainly not under the law.

How are we to judge intent when a mob is uttering the threat? I think it was meant to scare Modi don't you?

So; "If you’re facing a charge of uttering threats, three key three requirements must be satisfied before a court can find you guilty:

The threat must be real.

You must have intentionally made this threat.

You threatened death, causing bodily harm, damaging or destroying property, or harming an animal."

For sure it was an unpleasant display of animosity toward Modi.

For it to be a threat the speaker would have to say " I will kill Modi".

Telling the air or a random listener on the street to "kill Modi" is not a credible threat. Not a treat at all. It is not reasonable to expect that any listener would follow his orders and be capable of killing Modi. It was really just stupid talk.

In effect he was telling others to kill Modi because he would not do it himself.

If it were white Canadians chanting "kill Carney" or even saying the same thing "kill Modi" there would have been a massive City Police & RCMP deployment to arrest every last white protester.

Apparently cops are gung ho when one person says it but are more concerned about getting back home to supper and the TV when faced with a mob. Municipal officials should have some access to our armed forces when they are clearly outnumbered.

Canadian municipal officials do not care about law and order, especially when non-protected "oppressor" minorities are being threatened. Shooting, burning, and beating unpreferred minorities in Canadian cities is a-ok with mayors and police chiefs of Canadian cities. Canada is increasingly becoming like Syria, Pakistan, and Nigeria.
